With the approval of the provincial legislature, Islander Day was formally designated as a statutory holiday on November 28, 2008.

Initially, Islander Day was set for the second Monday of February, with the first observance on February 9, 2009. However, this raised concerns for federal government employees, who would have to choose between an August federal holiday and Islander Day. After discussions between provincial and federal authorities, the date was changed to the third Monday of February, starting in 2010.
